Assault & Battery
An assault as an unlawful attempt, coupled with a present ability, to commit a violent injury on the person of another and a battery is any willful and unlawful use of force or violence upon the person of another.
Penal Code §§ 240-248 codify the majority of criminal charges for assault and battery. Prosecutors have discretion to charge Assault and Battery crimes as either Felonies or Misdemeanors . Sentencing for such a charges can include up to 5 years of probation, jail or prison time, anger management classes, counseling, fines, community service, restraining orders, restitution, and bans from owning or possessing firearms.
